Kazakhstan Tightens Legal Measures Against Drug Trafficking

President Kassym-Jomart Tokayev has signed a series of legislative amendments aimed at strengthening Kazakhstan’s legal framework against the illegal trafficking of narcotics, psychotropic substances, and related precursors. The amendments, effective Jan. 2, introduce stricter penalties for the production and distribution of drugs while recalibrating punishments for individuals exploited as couriers.

Enhanced Accountability and New Provisions.

The new legislation significantly heightens criminal liability for those engaged in the production, distribution, and large-scale cultivation of narcotics, with a particular focus on dismantling organized criminal networks. Key provisions include:

Harsher Penalties for Key Offenders:

  • Drug manufacturers and distributors, including public officials involved in such activities, now face 15 to 20 years of imprisonment or life imprisonment, with mandatory property confiscation.
  • Distribution of narcotics in schools, to minors, or within organized criminal groups carries similar penalties.

Targeted Approach for Couriers:

  • First-time couriers, often coerced or exploited by criminal organizations, will face reduced sentences of 5 to 8 years, compared to the previous 5 to 10 years, provided no aggravating circumstances are present.
  • Repeat offenses will result in stricter penalties, ranging from 7 to 12 years of imprisonment, accompanied by property confiscation.

Expanded Criminal Liability:

  • New penalties address the illegal cultivation of narcotic plants, particularly when conducted by criminal groups or on a large scale.
  • The law introduces sanctions for the unlawful circulation of drug precursors, potent substances, and production equipment.
